>Compensation of £7,200 for a 20 year old lady - faulty shoe causes broken ankle.
Article by Personal Injury Team
On 8 July 2008, a 20 year old lady, Sophie King was awarded £7,200 compensation at Manchester County Court in relation to her claim against Dolcis Shoes..
The circumstances of the case were that the lady broke her ankle as a result of the £35.00 Dolcis stiletto heel breaking. The black peep-toe strappy shoes had a two and a half inch heel and she was injured during the course of a night out with friends in Manchester city centre. The injury occurred when she was walking down the tram platform and her shoe snapped and she went over on it.
As a result of the injury she had to have an operation and was in plaster and was unable to play sport and had to quit a holiday waitressing job.
Dolcis admitted liability for the accident.
The case could set a precedent for hundreds of other claims from women who have fallen over when their heels have malfunctioned. Miss King had redress in English law under the Sale of Goods Act. The claim may not have been so straightforward if the shoes were not new.
